§ 3Type and scope of services
1. Through the Application the Service Provider provides in particular the following services:
1.1. keeping an Account and Profile, including the public Profile page,
1.2. Discover and searching for Users by criteria (e.g. job title, industry, skills, goals, distance),
1.3. Messages, including group chats, and live audio rooms,
1.4. the Feed and groups,
1.5. publishing and browsing Events, signing up for Events and, where the feature is available, selling and buying Tickets for Paid Events (Part III),
1.6. publishing and browsing Offers, and Highlights,
1.7. AI Features and automatic translation of content,
1.8. the VIP Subscription,
1.9. Brands on Profiles, the Brand Catalog, Brand voting and ranking, the Dofollow Link, the Mybzz Badge and Brand Promotion (Part IV),
1.10. the Points programme, Invitations, Streaks, Rankings and achievements (Part V),
1.11. the Newsletter and notifications (e-mail, push, in-app).
2. The services are free of charge, except for the VIP Subscription, paid Highlights, the Dofollow Link purchased as a subscription and Brand Promotion. Tickets for Paid Events are sold by the Organizer, not by the Service Provider (§ 24). Prices of paid services are always shown in the Application before an order is placed.
3. The features available free of charge and in the VIP Subscription are described in the Application. The Service Provider may develop the Application, add new features and change or withdraw free features. A change or withdrawal of a feature included in a paid service during a Billing Period that materially worsens the User's position takes place in accordance with § 34. Some features may be available only in the mobile application or only on the website, and only in some countries.
4. The Application may display advertising and promotional content, including Highlighted Offers and promoted Brands. Paid content is labelled so that it can be recognised. The Service Provider is not responsible for the content of third-party advertising.
§ 4Conclusion of the agreement and technical requirements
1. The agreement for keeping an Account is concluded for an indefinite period when the Account is created. Agreements for other free services are concluded when the User starts using a given feature and last until the User stops using it or deletes the Account. Some features (e.g. viewing public Profiles, Events and the Brand Catalog) are also available without an Account - in that case the agreement is concluded when the User starts using the feature and terminates when they stop using it.
2. Agreements for paid services are concluded in accordance with Part II.
3. To use the Application you need a device with Internet access, an active mobile phone number and an e-mail address, and also:
3.1. for the mobile application - a device with a currently supported version of Android or iOS, as indicated on Google Play or the App Store,
3.2. for the website - an up-to-date browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript, cookies and browser local storage enabled.
4. The mobile application may only be downloaded from Google Play or the App Store. Using the mobile application also requires accepting the terms of the relevant store. Installing updates may be necessary for the Application to work properly.
5. The costs of the Internet connection and SMS messages are borne by the User in accordance with their agreement with their operator.
6. The User must use the Application in accordance with the law, the Terms and good practice, respecting the personal rights and intellectual property rights of third parties, provide true data and not supply unlawful content.
7. Specific risks of using electronic services include in particular malware, attempts to obtain data (phishing) and take over an Account, and fraud in contacts with other people. The Service Provider never asks for an SMS code by phone, e-mail or in Messages.
§ 5Account, registration and login
1. An Account can be created in the mobile application or on the website by providing a mobile phone number verified with a one-time SMS code. The User then provides their first and last name and an e-mail address, which is used for contact and for sending Account-related messages. The Service Provider may require the e-mail address to be confirmed with a code, in particular before an SMS code is sent, where the registration data (e.g. the country determined from the IP address and the phone dialling code) indicate a risk of abuse. The Service Provider may also make other registration and login methods available.
2. To create an Account, the User must tick a box confirming that they have read and accept the Terms and the Privacy Policy. The Service Provider records which version of the Terms the User accepted and when. Consent to receive marketing information is separate, voluntary and not a condition for creating an Account.
3. To use the Application, the User must add a profile photo clearly showing their face. The photo may be checked automatically for the presence of a face and also by a moderator. A photo in which no face is detected may be rejected; until a suitable photo is added, use of the Account is limited. A rejection of a photo can be appealed under § 12. The photo can be changed, but a Profile cannot be kept without a photo.
4. Login uses the phone number and a one-time SMS code. Users whose Accounts were created before phone number registration was introduced may, until this option is withdrawn, also log in with an e-mail address and password. Changing the phone number requires confirmation via a link sent to the Account's e-mail address and an SMS code sent to the new number.
5. The Service Provider may require additional verification (e.g. confirmation of the e-mail address or re-verification of the phone number) and use safeguards against automated account creation and abuse (e.g. CAPTCHA verification, limits, and blocks on numbers, IP addresses and countries). Until verification, access to some features may be limited.
6. A User may have only one Account. The Account is personal and may not be shared, sold or transferred to others. The User is responsible for keeping codes and login details confidential and for the consequences of disclosing them to third parties.
7. Uninstalling the mobile application does not delete the Account or cancel a subscription (§ 19).
§ 6Profile and User Content
1. Data provided on the Profile (including first and last name, photo, job title, company, type of employment, “About me” description, goals, skills, work experience, city and country, Brands, achievements and the Profile summary prepared by the AI Features) is visible to other Users. The public Profile page is also visible to people who are not logged in and may be indexed by search engines. The Account's phone number and e-mail address are not published on the Profile; contact details that the User adds to the Profile themselves (e.g. social media links, a contact e-mail address) may be visible to other Users on the terms described in the Application (e.g. to contacts or Users with a VIP Subscription).
2. The User uses their real first and last name on the Profile. An artistic or professional pseudonym under which the User is commonly known is allowed. Company and brand names are presented in the fields intended for them (e.g. company, Brands), not in the name field or in the profile photo.
3. The User is responsible for User Content and represents that they hold the rights to it and that its publication does not infringe third-party rights, in particular copyright, trade mark rights, personal rights and privacy, including the right to the image of people shown in photos.
4. By posting User Content, the User grants the Service Provider a free, non-exclusive licence, without territorial limitation, to use it to the extent necessary to provide the services and promote Mybzz, in the following fields of exploitation: recording and reproduction in the memory of servers and devices, displaying and making available in the Application and on public Mybzz pages, adapting the format (e.g. cropping, compression, changing resolution), automatic translation, and inclusion in the Newsletter, notifications and share graphics. The licence expires when the content or the Account is deleted, subject to copies whose deletion takes technical time, content already shared further by other Users and cases where retaining the content is required by law or necessary to establish, pursue or defend claims.
5. Deleted content may be kept for the period needed to complete the deletion process, ensure security and handle reports, as described in the Privacy Policy.
§ 7Discover, Messages, Feed, groups and Offers
1. In Discover, the User sees other Users' Profiles and can say they want to meet a person or skip the Profile. People who want to meet the User may be shown in the “Want to meet you” section, to an extent depending on the User's plan, on the terms described in the Application. The order of the Profiles shown depends among other things on distance, goals, activity and match.
2. The rules for starting conversations (e.g. with people who are not contacts) depend on the User's plan and are described in the Application. To protect Users against spam, the Service Provider may limit the number of new conversations started by new Accounts or by Accounts whose messages remain unanswered.
3. Messages are for communication related to the purpose of Mybzz. It is prohibited to send spam or mass or automated messages, to keep writing to people who do not reply, and to push other Users to move the conversation out of the Application (in particular to external messengers or services) or to collect their contact details (e.g. phone number, e-mail address, identifiers on external services) where this is pushy, mass, automated or unrelated to the purpose of Mybzz. The Service Provider may restrict sending links and attachments, in particular in group chats.
4. Sharing your own contact details and communicating outside the Application is entirely at the User's own risk. The Service Provider is not responsible for the content, course or consequences of communication outside the Application.
5. To ensure security, detect fraud, spam and other violations and handle reports, the Service Provider may analyse Messages automatically, and persons authorised by the Service Provider may access them to the extent needed for these purposes or to comply with a legal obligation.
6. The User may at any time remove a contact, delete a conversation or block another User, even if that User has not violated the Terms.
7. Posts, comments, polls and content in groups must comply with the community rules (§ 11). The creator of a group is responsible for its name, description and moderation of content in the group, within the tools made available to them. The “For you” Feed shows posts in an order set automatically (a recommender system within the meaning of Article 27 DSA). The main parameters include in particular: how recent the post is, other Users' reactions, the relationship with the author (e.g. a contact, previous interactions, the same city or industry), the form of the post and whether the User has already seen or reacted to the post. Posts by blocked people are not shown. The Application may also offer a chronological view of the Feed.
8. A User may publish Offers related to their business. An Offer must be true, lawful and concern real services or products. Offers may also be visible to people who are not logged in. An Offer is not an offer of the Service Provider - agreements between Users are concluded directly between them, and the Service Provider is not a party to them and is not responsible for their performance.
§ 8AI Features and automatic translation
1. The Application uses artificial intelligence models provided by an external provider (currently OpenAI) in the following features:
1.1. Profile summary - based on the User's “About me” description, job title, company, skills and active Offers, a short Profile summary, a list of what the User is looking for and offers, and highlighted excerpts of the description are prepared. The results are displayed on the Profile (including the public one) and may be used when suggesting contacts. The results are refreshed when the Profile or Offers change,
1.2. suggesting matching contacts - based on Profile data (including goals, description, job title, industry, skills and experience),
1.3. External Events - classification, editing of descriptions, reading of dates and prices and translation of information about Events from public sources (§ 23).
2. Next to other Users' Profiles, the Application may show an estimated match (e.g. as a percentage) and highlighted information, calculated automatically on the basis of, among other things, the results of the AI Features, mutual contacts, distance, shared Events, skills and activity. Matches and highlights prepared with the use of AI are indicative only.
3. The AI Features receive only the data needed for the given feature.
4. The results of the AI Features may be incomplete or inaccurate and are for assistance only - they are not an assessment of a person or a recommendation to enter into an agreement and have no legal effects. A User who believes that the summary of their Profile is wrong may change their “About me” description (which causes the results to be prepared again) or report it to contact@mybzz.com; the Service Provider may correct or hide incorrect results.
5. Content in the Application (e.g. posts, comments, polls, Offers, Event and Brand descriptions and, at the User's request, also Messages) may be automatically translated into the language of the User's interface. The translation is performed by the User's browser or device or by an external translation service (e.g. Google Translate). The translation is marked as automatic, and the recipient can display the original version at any time (“Show original”). The original content prevails.
6. Some decisions, in particular moderation decisions, may be taken with the use of automated tools. The User may appeal such a decision under § 12 - appeals are reviewed by a human. The processing of data by the AI Features and translation services is described in the Privacy Policy.
§ 9Device permissions: location, contacts, camera, microphone and notifications
1. Location. With the User's consent given in the device system or browser, the Application obtains the device's location while it is being used and sends it to the Service Provider in order to find people and Events nearby, calculate distances and determine the city and country on the Profile. Other Users are shown the distance or a distance range and the city and country, not exact coordinates. Refusing consent does not prevent use of the Application but limits location-based features; the Application may then use an approximate location determined from the country or IP address.
2. Contacts. With the User's permission (system permission), the mobile application may use the contact list in features chosen by the User, e.g. when adding people to a group chat or inviting friends. The User may invite selected people by SMS sent from their own phone and is responsible for ensuring that the invited people do not object to such contact.
3. Camera, photos and microphone. Access to the camera, photos and microphone is used only for features chosen by the User (e.g. profile photo, photos and voice messages in Messages, audio rooms, saving a QR code).
4. Notifications. With the User's consent, the Application displays push notifications. Types of notifications can be limited in the Account settings, and consent can be withdrawn in the device or browser settings.
5. Each permission can be withdrawn at any time in the device or browser settings.
§ 10Messages from Mybzz and the Newsletter
1. The Service Provider sends Users messages necessary to provide the services (service messages), in particular: verification codes, payment confirmations and invoices, notifications about other Users' activity (e.g. a new message, a comment, a person who wants to meet you), Account security information, moderation decisions and notices of changes to the Terms and the Privacy Policy. Service messages are sent regardless of marketing consents; activity notifications can be limited in the Account settings.
2. The Service Provider may send Users the Newsletter, which contains, among other things, popular Events, new people, Offers and featured Users. You can unsubscribe from the Newsletter at any time with one click on the link in the footer of the message or in the Account settings.
3. Commercial information (e.g. special offers, VIP Subscription promotions) is sent electronically in accordance with the law, in particular with the User's consent where consent is required. Consent can be withdrawn at any time in the Account settings or via the link in the message.
4. E-mails from the Service Provider may contain elements that show whether the message was opened and which links were clicked. Details are described in the Privacy Policy.
§ 11Community rules and Prohibited Content
1. Mybzz is a community of real people interested in business contacts. Every User treats others with respect. The rules apply to all content and behaviour in the Application: Profiles, posts, comments, Messages, groups, Events, Offers, Brands, audio rooms and calls. Parody and humour are also subject to these rules.
2. In particular, it is prohibited to:
2.1. impersonate other persons or entities, provide someone else's data, create multiple Accounts or a new Account after the previous one was deleted by the Service Provider for violations,
2.2. harass, intimidate, insult, threaten, discriminate (including on the basis of origin, nationality, race, religion, sex, sexual orientation, gender identity, age, disability or views), use hate speech or incite violence,
2.3. post pornographic, erotic or adult-only content, graphic content or any content sexualising minors,
2.4. post content infringing copyright, trade mark rights, personal rights, trade secrets or privacy, including publishing other people's image or data without their consent,
2.5. engage in spam, pyramid schemes, “get rich quick” schemes, fraud and scams (e.g. obtaining login details, SMS codes or payments), fake Offers, Events and Brands,
2.6. spread false information in order to mislead,
2.7. disrupt the Application: automated data collection (scraping), bots, circumventing security measures and limits, introducing malware,
2.8. record, copy and distribute content from the Application, in particular other Users' data and photos and the course of meetings and audio rooms, without the consent of the people concerned,
2.9. use logos or company names in the profile photo instead of the User's image, or add company names next to the first and last name (Brands are presented in the “Brands” section and in the Brand Catalog - Part IV),
2.10. disrupt meetings and conversations with off-topic, vulgar or inappropriate content.
3. Prohibited Content. Regardless of paragraph 2, Events, Brands, Offers, groups or other content relating to the following may not be published or promoted on Mybzz: gambling and betting (including casinos, bookmakers and poker for money), adult content (including adult subscription platforms such as OnlyFans), weapons, and drugs and intoxicating substances (including cannabis, THC and CBD offered for sale). The prohibition applies even if the activity is legal in the User's country. Prohibited Content does not include, in particular, content about help in recovering from addiction or information about an event venue such as a hotel with a casino.
4. The Service Provider uses automated filters to detect Prohibited Content (based on, among other things, keywords and domains). Content stopped by a filter is not published; if the User believes that the filter was wrong, they may appeal under § 12.
5. The Service Provider may refuse or restrict the publication of Events taking place in selected countries, as well as registrations from selected countries, in particular because of repeated abuse and fraud.
§ 12Reports, moderation, appeals and point of contact
1. Anyone (including people who are not logged in) may report content, a Profile, group, post or Event that they believe is illegal or violates the Terms - using the “Report” option in the Application (where available) or by e-mail to contact@mybzz.com. The report should contain an explanation of why the content is illegal or violates the Terms, a precise indication of the content (e.g. a link), the reporter's name and e-mail address (except for reports concerning offences referred to in Article 16(2)(c) DSA) and a statement that the reporter believes in good faith that the information in the report is accurate and complete. The reporter receives a confirmation of receipt and information about the decision if they have provided an e-mail address.
2. The Service Provider handles reports without undue delay, diligently, objectively and in a non-arbitrary manner. Unfounded or malicious reporting is a violation of the Terms. The reporter's data is not disclosed to the person concerned by the report unless required by law.
3. The Service Provider also uses automated tools to detect violations: checking profile photos for the presence of a face, Prohibited Content filters, protection against bots and spam, and the automated checking of Messages described in § 7(5). Decisions may be taken with the use of automated tools; the Service Provider indicates this in the statement of reasons.
4. In the event of a violation, the Service Provider may, depending on its seriousness, intent and the Account's history: issue a warning, remove content or restrict its visibility, restrict access to some features (e.g. Messages, Events, Ticket sales, voting in the Brand Catalog, the Points programme), temporarily suspend the Account and, in the case of serious or repeated violations, delete the Account and terminate the agreement (§ 14). Where there is a threat to life, health or the safety of persons, the Service Provider may notify the competent authorities. While a report is being investigated, the Service Provider may temporarily restrict the visibility of content or suspend the Account, for no longer than necessary.
5. The User concerned by a decision receives - at the latest when it is applied - a clear and specific statement of reasons, including the type of restriction, the facts and circumstances, information on the use of automated means, the basis of the decision (a legal provision or a provision of the Terms) and information on the possibility of appeal. This obligation does not apply to deceptive high-volume commercial content (spam).
6. An appeal against a moderation decision (or against a decision not to act on a report) may be submitted within 6 months of being informed of the decision, by e-mail to contact@mybzz.com and, for an automated rejection of a photo, also in the Application. The appeal is handled without undue delay by a person who did not take the original decision; the Service Provider informs the User of the outcome with reasons. The User may also use a certified out-of-court dispute settlement body within the meaning of Article 21 DSA and the courts.
7. The single point of contact for authorities of EU Member States, the European Commission, the European Board for Digital Services and Users is contact@mybzz.com. Communication is conducted in Polish or English.
§ 13Complaints
1. Complaints concerning the operation of the Application, paid services, the Points programme, Rankings, Invitations and the Brand Catalog can be submitted to contact@mybzz.com or in writing to the Service Provider's address for service. Complaints about Events and Tickets are submitted under § 27 and appeals against moderation decisions under § 12(6).
2. A complaint should contain: data allowing the Account to be identified (e.g. phone number or e-mail address), a description of the problem, the date it occurred and the expected resolution. Missing information does not mean that the complaint will not be handled, but it may take longer.
3. The Service Provider handles a complaint within 14 days of receiving it and sends the reply to the User's e-mail address or in another way indicated by the User, on a durable medium.
4. Towards Consumers, the Service Provider is liable for the conformity of digital content and digital services with the agreement under Chapter 5b of the Polish Consumer Rights Act. In the event of non-conformity, the Consumer may demand that conformity be restored and, if this is impossible, would involve excessive costs or the Service Provider has not restored conformity, declare a price reduction or withdraw from the agreement.
5. Refunds for purchases made on the App Store and Google Play are handled by the operators of those stores in accordance with their rules (§ 19); this does not exclude complaints to the Service Provider about the operation of the Application.
§ 14Termination and Account deletion
1. The User may at any time, without giving reasons and at no cost, terminate the agreement for keeping an Account:
1.1. by deleting the Account in the Application settings (mobile application: Settings - Delete account; website: Settings - Account - Delete account) or on the Mybzz website if this feature is available, or
1.2. by sending a statement from the e-mail address assigned to the Account, or stating the Account's phone number, to contact@mybzz.com - this method is also available to people who no longer have access to the mobile application. The Service Provider may ask for confirmation that the request comes from the Account owner.
2. The User may choose immediate deletion of the Account or freezing the Account for 30 days. A frozen Account is not visible to other Users; logging in during this period restores the Account, and after 30 days the Account is deleted.
3. An Account cannot be deleted while the User is the Organizer of upcoming Events with Participants or sold Tickets - these must first be cancelled or handed over. Deleting an Organizer's Account cancels their future Paid Events and refunds the full Ticket price (§ 25(7)), and Tickets bought by the User for future Events are cancelled under the refund rules of the given Event.
4. Deleting the Account does not cancel a subscription purchased on the App Store or Google Play - it must be cancelled in the store settings (§ 19). Subscriptions purchased on the website should be cancelled in the Account settings before the Account is deleted.
5. After the Account is deleted, the Profile, posts, comments, Offers, contacts, Points and settings are deleted. Messages previously sent to other Users remain in their conversations, marked “Account deleted”. The Service Provider retains data that it must or may store under the law (e.g. payment records and invoices) or to establish, pursue or defend claims (e.g. the record of acceptance of the Terms), as described in the Privacy Policy. Groups created by the User may be transferred to another group member.
6. The Service Provider may terminate the agreement for keeping an Account:
6.1. with immediate effect - in the event of a serious or persistent violation of the Terms or the law, after first calling on the User to stop the violation, unless such a call would be pointless given the nature of the violation (e.g. fraud, false identity, Prohibited Content, illegal content),
6.2. with 30 days' notice - for important reasons, in particular if the Application ceases to operate or its business model changes materially.
7. Decisions referred to in paragraph 6.1 are subject to § 12(5) and (6). If the agreement is terminated for the reasons referred to in paragraph 6.2 or through the fault of the Service Provider, the User receives a proportional refund of fees for the unused period of paid services purchased on the website.
8. Uninstalling the mobile application does not delete the Account. The Service Provider may delete an Account that has not been used for at least 24 months, after notifying the User by e-mail.
§ 15Intellectual property
1. The Application, its design, code, databases, Mybzz marks, graphics and texts prepared by the Service Provider are protected by law and belong to the Service Provider or its licensors. The Service Provider grants the User a non-exclusive, non-transferable, revocable licence to use the Application solely for its ordinary use in accordance with the Terms, for the duration of the agreement. Using elements of the Application to a greater extent requires the consent of the Service Provider.
2. It is prohibited to extract and re-use a substantial part of the contents of the Application's databases (in particular Profile, Event and Brand data), including by automated tools, and to decompile or modify the mobile application to the extent not permitted by law.
3. A User who uploads content to the Application is responsible for infringing third-party rights; if a third party brings claims against the Service Provider on this account, a User who is not a Consumer will indemnify the Service Provider and cover reasonable costs, and a Consumer is liable under general rules.
§ 16Liability
1. The Service Provider makes efforts to ensure that the Application operates without interruption and without errors, but reserves the right to technical breaks related to maintenance, updates or development. The Service Provider informs Users in advance, where possible, of planned breaks that may significantly affect the use of the Application. The Application may be unavailable in some countries.
2. The Service Provider is not a party to relationships, conversations or agreements between Users, including those based on Offers, and is not responsible for their performance. The Service Provider does not verify the accuracy of all data provided by Users and recommends ordinary caution in business contacts, in particular before transferring money or data.
3. As a hosting service provider, the Service Provider is not liable for User Content of whose illegal nature it is not aware and, upon obtaining reliable knowledge of its illegal nature, promptly disables access to it, in accordance with Article 6 DSA.
4. Towards Users who are not Consumers, the Service Provider's liability is limited to actual damage and to the amount of fees paid by the User to the Service Provider in the 12 months preceding the event giving rise to the damage. This limitation does not apply to damage caused intentionally.
5. Towards Consumers, the Service Provider is liable under general rules; the Terms do not exclude or limit Consumers' rights under mandatory provisions of law.
6. The User is liable for damage caused by violating the Terms or the law, including third-party claims related to User Content.
Part IIPayments and subscriptions
In short
- In the mobile app you pay through the App Store or Google Play, and on mybzz.com through Stripe. You see the price and period before you buy.
- The VIP Subscription, the Dofollow Link and Brand Promotion renew automatically until you cancel them; cancellation takes effect at the end of the paid period.
- A subscription bought on the App Store or Google Play can only be cancelled in the store - deleting your Account or uninstalling the app does not cancel it.
- Before you pay on the website, we ask for your consent to start the service immediately - this affects your right of withdrawal.
- We issue electronic invoices for website payments; for store purchases, the store does.
This summary makes reading easier and does not replace the text of the Terms.
§ 17General payment rules
1. Information about paid services in the Application is not an offer within the meaning of the Civil Code but an invitation to conclude an agreement. Before placing an order, the User sees a description of the service, the price (gross amount) and currency, the Billing Period and information on automatic renewal.
2. Payments are made:
2.1. in the mobile application - exclusively through the payment system of the App Store (Apple) or Google Play (Google), except for Tickets for Paid Events, which are purchased on a Stripe payment page opened in the browser (Part III),
2.2. on the website - through Stripe (the Stripe Checkout payment page), by payment card or another method made available by Stripe.
3. The Service Provider does not store full payment card details - they are processed by Stripe, Apple or Google.
4. An agreement for a paid service is concluded when the payment is successfully made (for the App Store and Google Play - when the User's store account is charged). Access to the service is granted promptly after the payment provider confirms the payment.
5. The price applicable at the time of purchase does not change during the paid Billing Period. Changes to the price of a recurring service for subsequent Billing Periods are governed by § 34(6).
6. Invoices. For payments on the website, the Service Provider issues invoices electronically and sends them to the User's e-mail address; invoices may also be available in the Account settings. A User who wants an invoice for a company enters the company name and tax identification number on the payment page before paying. Documents for purchases on the App Store and Google Play are issued by those stores. Invoices for Tickets are issued by the Organizer (§ 26(8)).
7. Right of withdrawal (website purchases). A Consumer who has concluded a distance agreement may withdraw from it within 14 days of its conclusion without giving reasons by sending a statement to contact@mybzz.com (they may use the model form in Annex 2 to the Polish Consumer Rights Act), subject to paragraph 8.
8. Before paying on the website for the VIP Subscription, a Highlight, the Dofollow Link or Brand Promotion, the Consumer ticks a box in which they expressly request that performance start before the withdrawal period expires and acknowledge that if they withdraw, they will pay for the period during which the service was supplied until withdrawal. Without this request, the payment cannot be accepted. The Service Provider records confirmation that the request was made. The Service Provider confirms the conclusion of the agreement and the request to the Consumer by e-mail, on a durable medium. The VIP Subscription, Highlights, the Dofollow Link and Brand Promotion are digital services supplied continuously. A Consumer who has made the request and withdraws within 14 days pays for the service supplied until withdrawal, in proportion to the period of supply (Article 35 of the Consumer Rights Act); the right of withdrawal expires once the service has been fully performed (Article 38(1)(1) of that Act).
9. Refunds. Refunds of payments made on the website are made by Stripe to the payment method used for the purchase, no later than 14 days after the request is accepted. A full refund immediately ends the service concerned (e.g. access to VIP features, a Highlight, the Dofollow Link or Brand Promotion) and cancels the subscription. Refunds for purchases on the App Store and Google Play are handled by those stores (§ 19).
10. VIP Subscription days obtained in the Points programme, through Invitations or granted by the Service Provider (e.g. in a promotion) extend the active VIP period or start a new one, are free of charge, cannot be exchanged for money and do not change the payment schedule of a paid subscription (the subscription payment is charged on the existing date).
§ 18VIP Subscription
1. The VIP Subscription gives access to additional features described in the Application before purchase, on the terms indicated in the Application. The scope of VIP features may change in accordance with § 3(3).
2. The VIP Subscription can be purchased:
2.1. on the website - in the variants and at the prices shown before purchase, paid through Stripe,
2.2. in the mobile application - on the App Store or Google Play, in the variants and at the prices shown in the Application before purchase; the store may offer a trial period on terms indicated before purchase (one trial per Account).
3. The VIP Subscription renews automatically for subsequent Billing Periods of the same length, and the fee is charged to the chosen payment method until the User cancels the renewal. An Account can have only one active VIP Subscription at a time - a Subscription cannot be bought on the website while a Subscription purchased in the mobile application is active, and vice versa.
4. Cancelling the renewal:
4.1. of a subscription purchased on the website - in the Account settings (VIP section) or in the Stripe customer portal, at any time; the cancellation can be undone until the end of the paid period,
4.2. of a subscription purchased in the mobile application - only in the App Store or Google Play settings (§ 19).
5. After cancellation, VIP features work until the end of the paid Billing Period. Cancelling the Subscription does not delete the Account - the Account continues in the free version. When the Subscription expires, VIP features are switched off; in particular, a hidden Profile becomes visible again.
§ 19Purchases on the App Store and Google Play
1. Subscriptions purchased in the mobile application are handled exclusively by the App Store or Google Play. Payments, renewals, cancellations and refunds are also subject to the terms of the relevant store. Payment is charged to the User's store account when the purchase is confirmed, and the subscription renews automatically unless cancelled at least 24 hours before the end of the current period; the store account is charged for the next period within 24 hours before it begins. If the User took a trial period or a promotional offer, the price for subsequent periods may be higher in accordance with the terms of that offer.
2. A subscription can only be cancelled in the store settings:
2.1. App Store - device Settings - [your name] - Subscriptions, or via Apple Support,
2.2. Google Play - Google Play app - Profile - Payments and subscriptions - Subscriptions, or via Google Play Help.
3. Deleting your Mybzz Account or uninstalling the mobile application does not cancel a subscription purchased on the App Store or Google Play. To avoid further charges, cancel the subscription in the store.
4. Refunds for App Store purchases are handled by Apple and for Google Play purchases by Google, in accordance with their rules; the Service Provider cannot make refunds for these purchases. Purchases can be restored on a new device using the “Restore purchases” button in the Application.
5. Provisions concerning the application downloaded from the App Store:
5.1. These Terms are concluded solely between the User and the Service Provider, and not with Apple Inc. or its subsidiaries (“Apple”). The Service Provider, not Apple, is solely responsible for the mobile application and its content.
5.2. The licence to use the mobile application is limited to use on any Apple-branded products that the User owns or controls, as permitted by the Usage Rules set out in the App Store terms, except that it may be accessed and used by other accounts associated with the User via Family Sharing or volume purchasing.
5.3. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the mobile application. Support is provided by the Service Provider at contact@mybzz.com.
5.4. In the event of any failure of the mobile application to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price of the application (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the mobile application. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the responsibility of the Service Provider under these Terms.
5.5. The Service Provider, not Apple, is responsible for addressing any claims of the User or any third party relating to the mobile application or its use, including product liability claims, any claim that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
5.6. In the event of any third-party claim that the mobile application or its use infringes that third party's intellectual property rights, the Service Provider, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any such claim.
5.7. The User represents and warrants that they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that they are not listed on any U.S. Government list of prohibited or restricted parties.
5.8. When using the mobile application, the User must comply with applicable third-party terms of agreement (e.g. their wireless data service agreement).
5.9. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon the User's acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against the User as a third-party beneficiary.
5.10. Questions, complaints or claims concerning the mobile application should be directed to the Service Provider: MYBZZ SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Nowogrodzka 31, 00-511 Warszawa, Poland, contact@mybzz.com.
§ 20Offer Highlights
1. A User may buy a Highlight of their Offer for 1 day or 7 days (or another period indicated before purchase). A Highlighted Offer is displayed in the space for Highlighted Offers and marked as highlighted. Highlighted Offers are displayed in rotation, so a Highlight does not guarantee a specific number of views, contacts or sales. Successive Highlights of the same Offer add up.
2. A Highlight is a one-off purchase (it does not renew). A paid Highlight can be bought in the way indicated in the Application. The Highlight starts promptly after payment is confirmed.
3. A User with an active VIP Subscription may use free Highlights in the number and on the terms indicated in the Application.
4. A Highlight does not release the User from complying with the Terms. The Service Provider may remove a Highlighted Offer that violates the Terms or the law; § 12 applies to decisions and appeals. If the removal did not result from the User's violation of the Terms, the User receives a refund of the fee for the unused part of the Highlight.
§ 21Dofollow Link and Brand Promotion
1. The Dofollow Link as a subscription can be purchased by the Brand Owner in the way indicated in the Application. The Billing Period is shown before purchase and is counted from the date of payment. The Dofollow Link is activated promptly after payment is confirmed. The rules of the Dofollow Link, including the free Dofollow Link for the Mybzz Badge, are set out in § 30.
2. Brand Promotion can be purchased by the Owner of a Brand published in the Brand Catalog as a monthly subscription. Promoted Brands are displayed in featured places of the Brand Catalog and marked as promoted; the placement and order are determined by the Service Provider and may change. Brand Promotion does not guarantee a specific number of views or clicks.
3. The price of Brand Promotion for new subscriptions is set by the Service Provider and may change, in particular depending on the number of active promotions. The current price and currency are shown before purchase. The price paid at purchase is locked for the duration of the subscription - subsequent renewals are charged at the same amount, regardless of changes in the price for new subscriptions, subject to § 34(6).
4. Dofollow Link and Brand Promotion subscriptions renew automatically for subsequent monthly Billing Periods until the User cancels them. Renewal can be cancelled at any time in the Account settings (subscriptions section) or in the Brand panel. Cancellation takes effect at the end of the paid period; until that day the service continues and the cancellation can be undone.
5. If the Brand Owner removes the Brand or cancels the subscription, the fee for the current Billing Period is not refunded and the subscription does not renew; the service is provided until the end of the paid period to the extent possible after the Brand is removed. If the Service Provider removes the Brand because the Brand Owner violated the Terms, the fee is not refunded. If the Service Provider removes the Brand through no fault of the Brand Owner, the Brand Owner receives a proportional refund of the fee for the unused period. The Consumer's rights under § 17(7)-(9) and under mandatory provisions of law remain unaffected.
6. Buying the Dofollow Link, Brand Promotion, a Subscription or any other service does not affect the Brand's position in the Brand Catalog ranking (§ 29(6)).
Part IIIEvents and Tickets
In short
- Events are created by Users (Organizers). We publish some Events ourselves based on public information - registration for them then takes place on the organizer's website.
- You buy a Ticket for a Paid Event from the Organizer, not from Mybzz. The payment goes through Stripe directly to the Organizer's account, and Mybzz charges the Organizer a commission.
- Mybzz provides a tool: it does not organise the Event and is not responsible for how it runs, for refunds made by the Organizer or for payouts to the Organizer.
- If an Event is cancelled, there are no seats left, or the date or venue changes materially, the system orders a full refund.
- Raise Event matters with the Organizer, and matters concerning how Mybzz works with us.
This summary makes reading easier and does not replace the text of the Terms.
§ 22Events on Mybzz
1. A User may create Events on Mybzz (e.g. meetings, conferences, workshops - online or in person), invite other Users to them, and browse, boost and share Events. The Organizer is responsible for the content and accuracy of information about the Event, in particular the date, venue, programme, price, number of seats and conditions of participation, as well as for how the Event runs and its compliance with the law.
2. Participation in a free Event may require the Organizer's approval. When there are no seats left, a User may join a waiting list; when a seat becomes free, people on the list may be added to the Event automatically. A Participant may receive a Ticket with a QR code checked by the Organizer at the entrance.
3. Events may be featured and sorted by popularity, including the number of boosts given by Users; the strength of a boost may depend on the User's Streak (§ 33).
4. Events may not concern Prohibited Content (§ 11(3)). The Service Provider may refuse or restrict the publication of Events taking place in selected countries (§ 11(5)).
5. The Organizer may use their own Meta pixel on the Event page. The Organizer's pixel only works for people who have consented to marketing cookies; to that extent, the Organizer is a separate controller of personal data.
6. The Service Provider may hide, cancel or remove an Event that violates the Terms, the law or third-party rights. § 12 applies to reports, information about decisions and appeals. Cancellation or removal by the Service Provider of a Paid Event for which Tickets have been sold results in a refund of the full Ticket price being ordered in accordance with § 26.
§ 23External Events
1. The Service Provider may publish on Mybzz information about public business events organised by third parties (External Events), prepared on the basis of publicly available information (e.g. public calendars, event websites, chambers of commerce and Organizers' websites): name, date, venue, price, a description in a shortened or edited form and the address of the Event page. For External Events, the Service Provider prepares its own graphic and description, including with the use of AI Features (§ 8), and translations. External Events are marked as coming from public sources.
2. Registration for an External Event and any payment take place outside Mybzz, on the Organizer's website and on terms set by the Organizer. The Service Provider is not a party to such registration or agreement, does not sell Tickets for External Events and is not responsible for how they run. Information about External Events may be out of date or incomplete - the information provided by the Organizer is binding and should be confirmed with the Organizer before attending.
3. The Service Provider may inform the Organizer of an External Event by e-mail, sent to a publicly provided contact address, that their Events have been published on Mybzz and that they can claim, correct or remove them.
4. The Organizer of an External Event may claim it on Mybzz free of charge: via a link sent by the Service Provider to the Organizer's e-mail address, after confirmation with a one-time code, or from an Account with a confirmed e-mail address of the Organizer or an address in the Organizer's domain. The claim covers that Organizer's Events published by the Service Provider. From the moment of claiming, the Organizer is responsible for the content of the Events under the Terms and may use the Organizer features.
5. The Organizer may at any time request the correction or removal of an Event published by the Service Provider, object to its publication or opt out of further messages - using the link in the message from the Service Provider, by replying to that message or by writing to contact@mybzz.com.
6. A person named in the information about an External Event (e.g. a speaker, guest or moderator) may at any time request the removal or correction of data concerning them (e.g. name, job title, photo) or object to its publication by writing to contact@mybzz.com. The Service Provider removes or corrects such data without undue delay and may, if necessary, hide the Event until it is corrected.
§ 24Paid Events - the Service Provider's role
1. Where the Ticket sales feature is available, an Organizer may sell Tickets for their Event through the Application after connecting their own Stripe account to the Application and meeting the requirements set out in § 25. The feature may be unavailable in some countries or currencies or for some Users.
2. The agreement for participation in a Paid Event (the Ticket sale agreement) is concluded solely between the Participant and the Organizer. The seller of the Ticket and the organiser of the Event is the Organizer. The Service Provider is not the seller of the Ticket, the organiser of the Event or a party to the Ticket sale agreement, is not a payment service provider and does not accept payments on behalf of the Organizer. The Service Provider only provides a technical service enabling the publication of the Event, the conclusion of the agreement between the Participant and the Organizer, payment processing through Stripe and the issuing and checking of Tickets.
3. Payment for a Ticket is made through Stripe directly to the Organizer's Stripe account (direct charge). The Service Provider does not hold Participants' funds and does not make payouts - payouts to the Organizer are made by Stripe under the agreement between the Organizer and Stripe. Stripe's terms also apply to payments. In the mobile application, the Stripe payment page opens in the browser.
4. For using the Ticket sales feature, the Service Provider charges the Organizer a commission in the amount shown in the Application before sales are enabled, deducted automatically by Stripe from each payment. The Ticket price shown to the Participant is the final price - the Participant does not pay the Service Provider any additional fees. Stripe fees are borne by the Organizer. The commission is non-refundable, unless the Service Provider decides otherwise (e.g. for refunds ordered through the Application) or a refund is required by law.
5. To the extent permitted by law, the Service Provider is not liable in particular for:
a) the cancellation, postponement, change, course or failure of the Event to take place,
b) non-performance or improper performance of the Ticket sale agreement by the Organizer, including refusal or delay of a refund, as well as the Organizer's insolvency, cessation of business or lack of contact with them,
c) lack of funds in the Organizer's Stripe account, withholding or absence of payouts to the Organizer, blocking or closure of the Organizer's Stripe account and Stripe's decisions,
d) the quality, content, programme, venue and safety of the Event and the behaviour of the Organizer and other participants,
e) the Organizer's performance of tax obligations (including VAT), the obligation to issue invoices and receipts and obligations towards consumers,
f) decisions in payment disputes (chargebacks) made by Stripe, banks and card schemes,
g) interruptions and errors of the systems of Stripe, banks and other payment providers.
6. The exclusions in paragraph 5 do not apply to the Service Provider's liability for the proper operation of the Application, including ordering refunds in the cases described in § 26, or to liability that cannot be excluded under mandatory provisions of law, in particular for damage caused intentionally.
§ 25Organizer of a Paid Event
1. To sell Tickets, the Organizer must: connect their own Stripe account (new or existing) to the Application and complete the verification carried out by Stripe, provide seller details (status: private individual or trader; first and last name or business name and e-mail address and, for a trader, also address, tax identification number, phone and country) and make a declaration in the Application about their seller status and that they are the seller of the Tickets responsible for the Event, refunds and payment complaints. Sales are set up on the website. The Organizer is responsible for the accuracy of the data provided.
2. The seller details are shown to Participants before they buy a Ticket. If the Organizer is a private individual, the Participant sees their first and last name or name and e-mail address, together with information that the seller is not a trader and that consumer protection law (e.g. the right of withdrawal) does not apply to the agreement with them.
3. The Organizer undertakes in particular to:
a) provide true and up-to-date information about the Event, including the date, venue, price, currency, number of seats and refund policy,
b) run the Event as described or cancel it without delay,
c) make refunds in accordance with their own refund policy, the Terms and the law,
d) comply with the law, including consumer protection, tax, event safety and Participants' personal data protection rules,
e) ensure that invoices and receipts for Tickets are correct - the invoice is created in the Organizer's Stripe account and the Organizer is responsible for its content, including VAT,
f) handle Participants' complaints and payment disputes (chargebacks) in the Stripe dashboard,
g) bear Stripe fees, the Service Provider's commission and the costs and losses related to refunds and payment disputes.
4. The Organizer sets the refund policy: a deadline (counted before the start of the Event, within the limits shown in the Application) until which the Participant can cancel a Ticket with a full refund, or no refunds. The Organizer may add a description of their own refund policy, which is shown to Participants and binds the Organizer. Once sales have started, the refund policy cannot be made stricter, the currency cannot be changed, the type of Event (paid or free) cannot be changed, and the number of seats cannot be reduced below the number of Tickets sold. The Ticket price must be within the limits (minimum and maximum price, supported currencies) shown in the Application.
5. Approval of sign-ups does not apply to Paid Events. Removal by the Organizer of a Participant who has bought a Ticket results in a refund of the full Ticket price. The Organizer cannot buy a Ticket for their own Event.
6. The Organizer receives the Participants' data necessary to organise the Event (first and last name, photo and Profile link, e-mail address, status and check-in time) and processes it as a separate data controller, solely for the purposes of organising the Event, settlements and handling complaints. Co-organizers do not see Participants' e-mail addresses.
7. Cancellation of a Paid Event by the Organizer results in a refund of the full Ticket price to all Participants, including those who previously cancelled a Ticket without a refund. A material change of the date or venue of the Event entitles Participants to cancel the Ticket with a full refund (§ 26(6)), and Participants are notified of this. The Organizer cannot disconnect their Stripe account from the Application while they have outstanding obligations towards Participants (in particular Tickets for future Events, unpaid refunds or open payment disputes). Disconnecting the Stripe account or deleting the Account does not release the Organizer from obligations towards Participants.
8. The Service Provider may suspend or block an Organizer's Ticket sales, cancel an Event (with a refund of the full Ticket price), order a refund and cooperate with Stripe in the event of suspected fraud, violation of the Terms or the law, or Participant reports. Sales may be suspended automatically, in particular in the event of an excessive number of payment disputes. The Service Provider informs the Organizer of the decision with reasons; an appeal is available under § 12.
9. An Organizer who is not a Consumer indemnifies the Service Provider against claims of Participants and third parties related to the Event, Ticket sales, refunds and the Organizer's settlements, to the extent that such claims result from the Organizer's acts or omissions.
§ 26Buying a Ticket, cancellation and refunds
1. Before buying, the Participant sees the final Ticket price and currency, the seller's (Organizer's) details together with information on whether they are a trader, and the refund policy.
2. A Participant may buy one Ticket for a given Event. During payment, the seat may be reserved for a limited time. Payment can be made by card or other methods made available by the Organizer in Stripe (e.g. Przelewy24). The Ticket sale agreement is concluded between the Participant and the Organizer when the payment is successfully made.
3. If, when the payment is booked, the Event has been cancelled, there are no seats left, the payment was duplicated or the Participant's Account has been deleted, the system automatically orders a refund of the full Ticket price.
4. The Participant may cancel a Ticket in the Application. If they cancel it before the refund deadline set by the Organizer, they automatically receive a full refund. After that deadline, and when the Organizer does not offer refunds, the Ticket can be cancelled without a refund - after the Participant's express confirmation. Cancellation with an automatic refund is not possible after the Event has ended or after the Participant's entry has been checked in. These provisions do not limit the rights granted to the Participant by the Organizer in the refund policy description.
5. Cancellation of the Event by the Organizer or by the Service Provider and removal of the Participant from the Event by the Organizer result in a refund of the full Ticket price being ordered automatically.
6. In the event of a material change to the Event after the Ticket was purchased - a change of start time, a change of venue (a different address or place) or a change of format from online to in-person or vice versa - the Participant may cancel the Ticket with a full refund regardless of the refund deadline, until the Event ends and provided they did not take part in it.
7. Refunds ordered through the Application are made by Stripe to the Participant's payment method, from the funds in the Organizer's Stripe account. The time it takes for the funds to arrive depends on Stripe and the Participant's bank. If a refund fails, the system retries it automatically, and then the Service Provider and the Organizer resolve the matter. The Organizer may also make a refund in the Stripe dashboard: a partial refund does not cancel the Ticket, and a refund of the full price cancels the Ticket.
8. The invoice for the Ticket is created by Stripe in the Organizer's account based on the data provided by the Participant at payment; the invoice may be available for download in the Application. The Ticket is personal and cannot be transferred to another person in the Application.
9. The seller of the Ticket is the Organizer, who sets the refund policy. If the Organizer is a trader and the Ticket concerns an Event on a specified date or during a specified period, the right of withdrawal from a distance agreement may be excluded under Article 38(1)(12) of the Polish Consumer Rights Act (services related to entertainment, sporting or cultural events where a day or period of performance has been specified). In other cases, a Participant who is a Consumer has the rights provided by law, which they exercise against the Organizer. If the Organizer is a private individual, consumer rights legislation does not apply to the Ticket sale agreement.
10. In the event of a payment dispute, the Participant should first contact the Organizer. Payment disputes (chargebacks) are decided by Stripe, banks and card schemes; a decision in favour of the Participant cancels the Ticket.
§ 27Complaints and reports concerning Events
1. Complaints concerning the Event, how it ran, the Ticket, the refund policy and invoices are submitted by the Participant to the Organizer, using the seller details provided in the Application. The Organizer handles them in accordance with the law.
2. Complaints concerning the operation of the Application, including the purchase process and the automatic refunds described in § 26, are submitted to the Service Provider under § 13.
3. Events that violate the law or the Terms (e.g. fraud, a fake Event, an Event that did not take place, misleading information, illegal content, spam) can be reported using the “Report” option on the Event or under § 12. The Service Provider informs the reporter of the decision and the Organizer of the decision with reasons. The decision may include a warning, cancellation of the Event with a refund of the full Ticket price or suspension of Ticket sales.
Part IVBrands, Brand Catalog, ranking and links
In short
- You can show your brands, companies or projects on your Profile - you must have the right to do so.
- The Brand Catalog (mybzz.com/brands) is public. A brand can be submitted by a logged-in User, a guest after confirming their e-mail, or Mybzz based on public information - the owner can claim or remove it free of charge.
- Logged-in Users can vote for brands and boost them on the terms shown in the Brand Catalog. A ranking position cannot be bought, and manipulation leads to votes being cancelled.
- Links to brand websites are “nofollow” by default. You get “dofollow” for free for the Mybzz Badge on your website or with a paid subscription - with no guarantee of results in Google.
This summary makes reading easier and does not replace the text of the Terms.
§ 28Brands on Profiles and the Brand Catalog
1. A User may add Brands (in the number indicated in the Application) they are associated with (e.g. a company they run, a brand or a project) to their Profile, providing the Brand name and optionally a logo, website address, short description, tags and category. Brands added to a Profile are public: they are visible on the Profile, including to people who are not logged in and in search engines, and are presented in the Brand Catalog.
2. By adding or submitting a Brand, the User represents that they are entitled to present it, including to use the Brand's name, logo and other identifiers, and that the information provided is true and does not infringe third-party rights, in particular trade mark rights, business name rights, copyright in the logo and images, and personal rights. The person who added the content concerning a Brand is responsible for it; § 15(3) applies accordingly. Brands may not concern Prohibited Content (§ 11(3)).
3. The Brand Catalog is public and available without logging in at mybzz.com/brands. A Brand may be added to the Brand Catalog:
a) from a Profile - Brands added to a Profile are presented in the Brand Catalog,
b) by a logged-in User - the submitted Brand is published immediately or after verification by the Service Provider,
c) by a person who is not logged in (a guest) - the submitter provides their name and e-mail address, accepts the Terms and agrees to be contacted about the Brand; the Service Provider sends a confirmation link to that address, and without confirmation the Brand is not published. After confirmation, the Brand is published immediately if the submitter's e-mail address belongs to the domain of the Brand's website, and otherwise after verification by the Service Provider,
d) by the Service Provider - on the basis of publicly available information (e.g. name, website address, logo or site icon, category, short tagline, publicly provided contact address) obtained in particular from Brands' websites, publicly available directories and from partners the Service Provider works with.
4. If no logo has been added, the Brand's logo may be fetched automatically from the Brand's website or from publicly available services. A set of questions and answers (FAQ) may be prepared automatically for a Brand based on its data; the Brand Owner may edit, add to or reset it.
5. The Brand Owner may add a cover image and Brand images in the number and size indicated in the Application. Images must show the Brand and belong to the Brand Owner or be used with the consent of the rights holder; they may not contain adult content, violence, third parties' personal data or third-party trade marks. The Service Provider may remove images that violate these rules.
6. Submitting a Brand does not in itself constitute claiming it and does not give the submitter the rights of a Brand Owner.
7. A person authorised to represent a Brand may claim, free of charge, a Brand added to the Brand Catalog by another person or by the Service Provider: by entering an e-mail address in the domain of the Brand's website or the Brand's contact address, to which a one-time code is sent, via a link sent by the Service Provider to the Brand's e-mail address, or from an Account with a confirmed e-mail address in the domain of the Brand's website. After claiming, the Brand Owner can edit the Brand's data, and the Brand is linked to their Profile. If a Brand has been claimed by an unauthorised person, the authorised person may report this to contact@mybzz.com, and the Service Provider may, after verification, reverse the claim, hide the Brand or transfer it to the authorised person.
8. A person entitled to a Brand may at any time, without giving reasons, request the removal of the Brand from the Brand Catalog or object to its presentation - using the link in the message from the Service Provider, by replying to that message or by writing to contact@mybzz.com. The unsubscribe link in messages concerning the Brand Catalog stops further messages, and the unsubscribe page also allows an unclaimed Brand to be removed from the Brand Catalog. The Service Provider removes the Brand promptly after receiving a justified request.
9. The Service Provider may refuse to publish a Brand, hide or remove a Brand or an element of it (e.g. logo, description, image or link) if the Brand violates the Terms, the law or third-party rights, is misleading or has been successfully reported by an entitled party. § 12 applies to reports, information about decisions and appeals.
10. A User adding a Brand grants the Service Provider a non-exclusive, free licence, without territorial limitation, to use the Brand's name, logo, description and images to the extent necessary to present the Brand in the Application, the Brand Catalog, the ranking results, messages about the ranking results and share graphics - for as long as the Brand is presented in the Application.
§ 29Voting, boost and ranking
1. Only logged-in Users can vote for and boost Brands. A Brand Owner cannot vote for or boost their own Brand.
2. The voting rules (e.g. number of votes per Brand per month, value of a vote in ranking points, possibility to withdraw a vote) are shown in the Brand Catalog.
3. A User may boost Brands on the terms (e.g. frequency, value in ranking points) shown in the Brand Catalog. A boost cannot be withdrawn or transferred to another Brand. Votes and boosts are free of charge.
4. The monthly ranking covers ranking points collected in a given calendar month and closes at the end of the last day of the month, Polish time. Results of closed months are published in the archive (“Winners”), and the Service Provider may inform Brand Owners of the places they have taken.
5. The following are publicly visible next to a Brand: the people who voted for it in a given month (first name, initial of the surname, profile photo and Profile link), the number of votes, a short Profile of the Brand Owner and - in the public activity view of the Brand Catalog - information about who voted for or boosted the Brand and when. Hidden and blocked Accounts are not shown.
6. A ranking position cannot be bought. The ranking is not sponsored, and buying the Dofollow Link, Brand Promotion, a Subscription or other services does not affect a Brand's position in the ranking.
7. Manipulating voting and the ranking is prohibited, in particular: using fake, someone else's or multiple Accounts, using bots and scripts, buying and selling votes or boosts, offering or accepting benefits in exchange for a vote or boost, and trading or swapping votes. In the event of a violation, the Service Provider may cancel votes and boosts, block the User from voting, remove the Brand from the ranking (also after the month has closed, with the results corrected) and apply the measures referred to in § 12(4).
8. For votes and boosts, the User may receive Points under Part V.
9. The ranking is for information only and is not a recommendation or assessment of a Brand by the Service Provider. A ranking position does not give a right to a prize, unless the Service Provider announces otherwise in separate rules before the given month begins.
§ 30Mybzz Badge and links to Brand websites
1. Links from the Application (from Profiles and the Brand Catalog) to Brand websites are marked with the “nofollow” attribute by default.
2. A link to a Brand's website becomes a Dofollow Link:
a) free of charge - for as long as the Brand's website contains the Mybzz Badge or another link to mybzz.com without the “nofollow”, “sponsored” or “ugc” attributes, verified by the Service Provider,
b) for a fee - for the duration of a Dofollow Link subscription purchased under § 21,
c) by decision of the Service Provider - e.g. as part of a cooperation or promotion, for the period indicated by the Service Provider.
3. The Service Provider checks the Mybzz Badge automatically after it is submitted and then periodically by fetching the Brand's website. If the Badge is removed or marked with an attribute referred to in paragraph 2(a), the Service Provider informs the Brand Owner by e-mail and may grant a grace period to restore it; after that the link returns to “nofollow”. Temporary unavailability of the Brand's website does not cause a change.
4. The Dofollow Link service consists solely in publishing a link without the “nofollow” attribute in the Application. The Service Provider does not guarantee any results in search engines, in particular the position, traffic or indexing of the Brand's website - search engines decide independently how to take links into account.
5. The Service Provider may change a link to “nofollow” or remove a link (including a Dofollow Link) if the Brand's website contains spam, illegal content, Prohibited Content, harmful content (e.g. malware or phishing), misleading content or content violating the Terms. The Service Provider informs the Brand Owner of such a decision with reasons; an appeal is available under § 12.
6. The Service Provider grants the Brand Owner a non-exclusive, free and revocable licence to place the Mybzz Badge on the Brand's website in the form provided by the Service Provider. The Badge may not be modified or used in a way suggesting a recommendation, partnership or guarantee by the Service Provider.
Part VPoints, Invitations, Streaks and Rankings
In short
- You collect Points for activity on Mybzz and can exchange them for VIP days. Points have no monetary value.
- You invite new people with your link; rewards are for people who actually create and verify an Account, not for merely sharing.
- Rankings are calculated from objective activity data; they are not a lottery or a contest with cash prizes.
- The current numbers (Points per action, exchange thresholds, limits) are always shown in the Application. Cheating leads to losing rewards.
This summary makes reading easier and does not replace the text of the Terms.
§ 31“Free VIP for activity” programme (Points)
1. The Points programme is free of charge and voluntary. Every User with an active Account takes part in it, if the programme is switched on.
2. Points are awarded for activity in the Application, in particular for: visits on consecutive days, completing daily tasks (e.g. boosting an Event, viewing Profiles, adding a post or comment, sharing after which a new person opened the User's link), the reach of links shared by the User (new people who opened the link), votes and boosts in the Brand Catalog, successful Invitations, keeping a Streak and achievements. The current list of actions, the number of Points for each and the daily limits are described in the Application. Each action is rewarded once in the period indicated in the Application; merely clicking “Share” is not rewarded.
3. Points can be exchanged for VIP Subscription days according to the thresholds shown in the Application. Exchanges may be limited in frequency, of which the User is informed before the exchange. Exchanged Points are deducted from the balance; the balance cannot be negative. § 17(10) applies to VIP days.
4. Points have no monetary value, cannot be exchanged for money or benefits other than those indicated in the Application, are not inheritable and cannot be transferred to other Accounts or sold. The same applies to the units (“coins”) of the earlier referral programme in the mobile application.
5. Points may expire on the terms indicated in the Application. Deleting the Account results in the loss of accumulated Points.
6. It is prohibited to obtain Points in a way that is contrary to the Terms or the purpose of the programme, in particular: creating additional Accounts, inviting yourself, automating actions (bots, scripts), artificially generating link visits and mutually “boosting” activity in collusion with other Users. In the event of a reasonable suspicion of abuse, the Service Provider may suspend the awarding of Points, deduct Points, withdraw VIP days obtained through abuse and, in serious cases, block the Account. § 12(5) and (6) apply to decisions and appeals. The Service Provider may also award Points manually, e.g. as compensation or in a promotion.
7. The Service Provider may change the rules of the programme (e.g. the number of Points for actions, exchange thresholds) or end the programme, informing Users in advance. Until the changes take effect, the User may exchange accumulated Points under the existing rules. Changes that are favourable to Users may take effect immediately.
§ 32Invitations
1. Every User has a personal Invitation link and code. The code can be changed to a custom one, subject to the restrictions shown in the Application (e.g. frequency of changes, a ban on codes containing the name Mybzz or that are misleading, offensive or infringe third-party rights). Links shared from the Application may contain the User's Invitation code.
2. An Invitation is successful when a new person creates an Account from the Invitation link or code (or enters the code within the period indicated in the Application after creating the Account) and their Account is verified: it has a profile photo, a confirmed phone number or e-mail address and is not blocked, frozen or deleted. An Invitation can be assigned to only one inviter, and a User cannot use their own code.
3. For a successful Invitation, the inviter receives Points and the invited person receives a one-off number of VIP Subscription days, in the amounts shown in the Application when the invited person registers. The Service Provider may provide additional rewards for further thresholds of successful Invitations, described in the Application.
4. Invitations may only be sent to people who may be interested in Mybzz and in a lawful manner, in particular in compliance with the rules on unsolicited commercial communications. It is prohibited to mass-send links (spam), pose as the Service Provider, invite yourself or fictitious people, or create Accounts using someone else's data.
5. In the event of abuse, the Service Provider may refuse or withdraw a reward, reset the Invitation code or block the Account, in accordance with § 31(6).
§ 33Streaks, Rankings, achievements and share graphics
1. A Streak increases for each consecutive day on which the User opened the Application (in their time zone). Streak protection (a “shield”) may cover a single missed day on the terms described in the Application (e.g. as part of the VIP Subscription). A Streak may increase the strength of Event boosts.
2. Rankings are kept for calendar months (Polish time) and cover: the longest Streaks, the most active authors of posts and comments and the most successful inviters (number of successful Invitations). A Ranking position results solely from objective activity data; in the event of a tie, additional criteria set by the Service Provider decide. Hidden, blocked, frozen and deleted Accounts are not included.
3. Rankings are public - including for people who are not logged in - and show the position, score, first name and initial of the surname, photo, job title, company, Points balance and Profile link. Participation in Rankings is free of charge and does not depend on chance; Rankings are not a game of chance, lottery or contest with cash prizes.
4. The best Users of the month may be featured: shown on the Mybzz homepage, in the Newsletter and in the Application, and receive a badge. If the Service Provider announces prizes for a given month (e.g. VIP Subscription days), their type, number and method of award will be described in the Application before that month begins. Prizes cannot be exchanged for money. A User who does not want to be featured may notify contact@mybzz.com.
5. For certain actions, the User may receive achievements (badges), publicly visible on their Profile, and associated Points, on the terms described in the Application.
6. The Application allows the creation of graphics and pages for sharing (e.g. with a Ranking result, Streak, achievement or Profile). A share page is public and contains data selected by the Application at the time it is created (e.g. first and last name, photo, job title, company, result and Invitation code). The User decides whether to share it outside the Application.
7. § 31(6) on abuse applies accordingly. A result obtained in violation of the Terms may be cancelled.
Part VIChanges to the Terms and final provisions
In short
- We inform you of changes to the Terms at least 30 days in advance - by e-mail and with a notice in Mybzz. If you do not agree, you can delete your Account free of charge before they take effect.
- The Terms are governed by Polish law, but as a consumer you keep the protection of the law of the country where you live.
- We try to resolve disputes amicably; consumers can get help from consumer ombudsmen, the Trade Inspection or the courts.
This summary makes reading easier and does not replace the text of the Terms.
§ 34Changes to the Terms
1. The Service Provider may change the Terms for important reasons, in particular in the event of: changes in the law or its interpretation, a court ruling or a decision of an authority, the introduction, change or withdrawal of features of the Application or programmes (Points, Invitations, Rankings), changes in prices or payment rules, security reasons or protecting Users against abuse, changes to the Service Provider's details, or the need to clarify provisions.
2. The Service Provider informs Users of a change at least 30 days before the date on which it takes effect: by e-mail sent to the address assigned to the Account, in the Account's language, and by a notice on the website displayed to logged-in Users and, where technically available, also in the mobile application. The e-mail about the change is a service message and is also sent to people who have not consented to commercial information. The information contains a summary of the changes, a link to the new text of the Terms, the effective date and information on the right to terminate the agreement.
3. A User who does not accept the changes may terminate the agreement free of charge before the date on which they take effect, by deleting the Account or sending a statement to contact@mybzz.com. The previous version of the Terms applies until the changes take effect. Using the Application after the changes take effect means acceptance of the new version; the Service Provider records the date of notification and the date of acceptance. The Service Provider may also ask for express acceptance of the new version at the next login.
4. Changes may take effect earlier, without the period in paragraph 2, if required by law or a decision of an authority, or if necessary to address an unforeseen and imminent threat to the security of Users or the Application, including fraud or malware. Purely editorial changes that do not affect Users' rights and obligations may be made without notification by e-mail, with the new version and date indicated.
5. All versions of the Terms with the dates during which they apply are available at https://mybzz.com/terms. An upcoming change is marked on that page together with its effective date.
6. A change in the price of the VIP Subscription or another recurring service purchased on the website does not apply to a paid Billing Period. The new price applies from the first Billing Period beginning at least 30 days after notification, and the User may cancel the renewal before that date. Price changes for subscriptions purchased on the App Store and Google Play follow the rules of those stores.
§ 35Final provisions
1. Agreements concluded under the Terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded to them by mandatory provisions of the law of the country in which they have their habitual residence.
2. Disputes with Consumers are resolved by the courts having jurisdiction under the Polish Code of Civil Procedure. Disputes with Users who are not Consumers are resolved by the court having jurisdiction over the Service Provider's registered office.
3. The Service Provider seeks to resolve disputes amicably. A Consumer may use out-of-court complaint and redress procedures, in particular: apply to a permanent consumer arbitration court at the Voivodeship Inspector of Trade Inspection, apply to the Voivodeship Inspector of Trade Inspection to initiate mediation, or obtain free assistance from a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection. Information about these procedures and bodies is available at https://uokik.gov.pl. A Consumer living in another European Union country may obtain help from the European Consumer Centre in their country. Using out-of-court procedures is voluntary and requires the consent of both parties.
4. If any provision of the Terms proves invalid or ineffective, the remaining provisions remain in force, and the relevant provisions of law apply in place of the invalid provision.
5. The User's rights and obligations under the agreement may not be transferred to third parties without the consent of the Service Provider.
6. The Terms are drawn up in Polish and are also made available in English. In the event of discrepancies, the Polish version prevails, unless mandatory provisions of law provide otherwise.
7. Contact with the Service Provider: contact@mybzz.com, address for service: ul. Nowogrodzka 31, 00-511 Warszawa, Poland.
The first version of the Terms has applied since 11 March 2022. The effective date of this version is shown on the Terms page (mybzz.com/terms) and in the notice of the change to the Terms.
